Acceptance and Eligibility
By using DolphinRadar, you agree to these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract.
Account Responsibilities
You are responsible for:
● maintaining the confidentiality of your account credentials;
● all activity under your account;
● ensuring your use complies with applicable law and these Terms.
You must not share accounts in a way that violates plan limits or security requirements.
Permitted Use and Prohibited Conduct
Permitted use
You may use DolphinRadar for lawful analytics, monitoring, and informational purposes consistent with the Service design.
Prohibited uses
You may not use DolphinRadar to:
● harass, stalk, intimidate, or unlawfully monitor others;
● violate privacy rights, platform rules, or applicable laws;
● attempt to gain unauthorized access to systems or data;
● reverse engineer, scrape, or overload the Services beyond reasonable use;
● You may not rely on AI outputs as the sole basis for actions that could materially impact individuals, accounts, or legal rights without appropriate human review;
● input or solicit highly sensitive data in ways that create risk (see Section 7 of Privacy Policy);
● use outputs for high-risk decisions without appropriate human review (see AI disclaimers below).
We may investigate violations and take action including suspension.
AI Feature Terms (No Overclaim, Verifiable Boundaries)
Nature of AI outputs
AI outputs are generated probabilistically and may be incorrect, incomplete, or outdated. AI outputs:
● are provided for informational purposes only;
● do not constitute professional advice (legal, medical, financial, psychological, etc.);
● should be independently verified before you act.
No warranty; no guarantee
We do not warrant that AI outputs are accurate, reliable, or fit for any purpose. We do not guarantee results, growth, relationships, or outcomes.
Capability boundaries
The Chatbot is a read-only assistant. It cannot:
● perform Instagram actions (post/DM/like/follow/unfollow),
● access private accounts without lawful permission,
● bypass security controls,
● provide instructions for wrongdoing or invasive surveillance.
Subscriptions, Cancellation, and Post-Cancellation Demo
Billing
Subscriptions renew automatically unless canceled. Pricing, plan features, and billing cadence are described at purchase time.
Cancellation and Memory clearing
After cancellation, Memory is cleared as described in the Privacy Policy (Section 9.2). If a limited Demo Mode is offered:
● it may use sample/illustrative data;
● it does not imply ongoing entitlement to paid features.
Refunds
Refund policy: Since Dolphin Radar is offering non-tangible irrevocable goods we do not issue refunds once the report is delivered and available at your dashboard. You are eligible for a refund only in certain cases. We DO honor requests for refund if we continuously fail to deliver the product (note: the process of delivering reports can be slow and take longer than you expect; this alone does not make you eligible for a refund). Please contact support, and if we fail to deliver the equal amount of monitoring time to your Dolphin Radar balance at least 5 more times you can submit a refund request in written form within 7 days from the order placing date. We also honor refunds for product not-as-described if reported within 7 days from purchase with clear evidence that the delivered product is not as described.

You can cancel your subscription through your Dashboard account settings (e.g., Account/Billing/Subscription management).
Intellectual Property
DolphinRadar and its content, software, UI, and trademarks are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Services for your internal and lawful purposes.
You retain rights to content you submit, subject to the license in the User Content License section.
User Content License
To operate the Services, you grant DolphinRadar a limited license to host, process, reproduce, and display content you submit (including Chat Content) solely to provide, secure, and improve the Services, consistent with the Privacy Policy and your settings.
DMCA / Copyright Complaints
We respect intellectual property rights and respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”).
If you believe that content available through the Services infringes your copyright, you may submit a written DMCA notice to our designated agent with the following information:
● identification of the copyrighted work claimed to have been infringed;
● identification of the allegedly infringing material and its location;
● your contact information;
● a statement that you have a good-faith belief that the use is not authorized;
● a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf;
● your physical or electronic signature.

We may remove or disable access to allegedly infringing material and may terminate accounts of repeat infringers in appropriate circumstances.
Disclaimers
The services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, dolphinradar will not be liable for indirect, incidental, special, consequential, or punitive damages.
Some jurisdictions do not allow certain limitations; in those cases the limitation applies to the maximum extent permitted.
Indemnification
You agree to indemnify and hold DolphinRadar harmless from claims arising out of your unlawful use of the Services, your violation of these Terms, or your infringement of third-party rights.
Dispute Resolution; Governing Law
Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which DolphinRadar has its principal place of business, without regard to conflict of law principles.
Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration.
The arbitration shall be conducted by a neutral arbitrator appointed by a court of competent jurisdiction in the jurisdiction of DolphinRadar’s principal place of business and shall be conducted in accordance with applicable law.
Class Action Waiver
You and DolphinRadar agree that any dispute must be brought in the parties’ individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Small Claims Option
Either party may bring an individual claim in small claims court if the claim qualifies.
Venue for Non-Arbitrable Claims
If a claim is found not subject to arbitration, it shall be brought exclusively in the state or federal courts located in the jurisdiction of DolphinRadar’s principal place of business, and the parties consent to personal jurisdiction in those courts.
Termination
We may suspend or terminate access if you violate these Terms, create risk, or misuse the Services. You may stop using the Services at any time and cancel your subscription.
