Dolphin Radar Terms of Use
Last Updated: May 20, 2026These Terms of Use ("Terms") form a binding agreement between you and SESHAT LAB PTE. LTD., a Singapore private limited company with its registered office at 10 Anson Road, #28-18 International Plaza, Singapore 079903 (operating the service under the brand "dolphinradar"; collectively "dolphinradar," "we," "us," or "our"), governing your access to and use of the dolphinradar.com website, dashboard, and related services (collectively, the "Service").
By creating an account, subscribing to a paid plan, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
A. The Service
A.1 What dolphinradar Does
dolphinradar is an analytics tool that helps you understand publicly available Instagram activity. You provide Instagram usernames you wish to track; we aggregate publicly accessible information about those accounts — such as their public posts, public likes, public follows, public follower changes, and other publicly visible signals — and present it as digestible reports inside your dashboard. We also use AI to generate descriptive insights about the public activity of tracked accounts; these AI outputs are approximations for informational purposes only (see Privacy Policy Section 3.3).
We do not access private accounts, private messages, private stories, or any data that is not visible to the general public on Instagram. We are not affiliated with, sponsored by, or endorsed by Instagram, Meta Platforms, Inc., or any of their subsidiaries.
A.2 No Affiliation with Instagram
Instagram®, Facebook®, Meta®, and related marks are trademarks of Meta Platforms, Inc. Our use of Instagram-related terminology is purely descriptive of the platform we observe. We have no commercial, technical, or legal relationship with Meta. Meta does not review or endorse our reports.
B. Eligibility
B.1 Age
You must be at least 18 years old to use the Service. If you are between 13 and 17, you may only use the Service with the verifiable consent of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not intended for and may not be used by anyone under 13.
B.2 Eligible Regions / Excluded Regions
The Service is offered to users in the following regions ("Eligible Regions"):
● The United States (excluding Illinois and Texas, see below)
● Canada
● Australia and New Zealand
● Japan, South Korea, Singapore, Hong Kong, Taiwan
● Brazil, Mexico, Argentina
● The United Arab Emirates, Saudi Arabia
● Other regions where we accept registrations and not listed below as excluded
The Service is not offered, and may not be used by residents of, the following regions ("Excluded Regions"):
● The European Economic Area (EEA), the United Kingdom, and Switzerland
● The Russian Federation, the Republic of Belarus, the Democratic People's Republic of Korea, the Islamic Republic of Iran, the Syrian Arab Republic, Cuba, and any region subject to comprehensive U.S., EU, or UN sanctions
● The State of Illinois, United States (due to the Biometric Information Privacy Act)
● The State of Texas, United States (due to the Texas Capture or Use of Biometric Identifier Act)
● Mainland China
You are responsible for confirming your eligibility before signing up. By creating an account, you represent and warrant that you are not a resident of any Excluded Region. If we later determine you are a resident of an Excluded Region, we reserve the right to suspend or terminate your account and refuse refunds for unused subscription periods. We are not obligated to actively verify residency before, during, or after account creation; the responsibility to comply with this Section B.2 rests with you.
B.3 Account Holder Status
You must provide accurate registration information and keep it current. You are responsible for all activity under your account, including any usage by people you allow to access it. Notify us immediately at [email protected] if you suspect unauthorized access.
B.4 Eligibility Confirmation at Signup
By clicking "Sign Up," "Create Account," "Subscribe," or otherwise registering for the Service, you confirm under your own responsibility that:
(a) you are at least 18 years old (or 13–17 with verifiable parental consent);
(b) you are not a resident of, and not currently located in, any Excluded Region listed in Section B.2;
(c) all information you provide at registration is true, accurate, and complete;
(d) you have read, understood, and agree to these Terms and our Privacy Policy.
We rely in good faith on these representations. Any false representation may result in immediate account termination without refund.
C. Acceptable Use and Prohibited Uses
C.1 Permitted Uses
You may use the Service for lawful purposes consistent with these Terms — for example, to monitor public Instagram accounts you operate, to research competitor activity for legitimate marketing analysis, to track public influencer engagement for business decisions, or to understand the public activity of accounts you have a reasonable interest in observing.
C.2 Prohibited Uses
You agree not to use the Service to:
(a) Surveil individuals without lawful basis — track a current or former intimate partner, family member, employee, or any individual where applicable law (including stalking, harassment, anti-domestic-violence, or wiretapping statutes) prohibits such monitoring;
(b) Monitor minors — track Instagram accounts belonging to anyone you know or reasonably should know to be under 18, unless you are the parent or legal guardian of that minor;
(c) Aid harassment or stalking — use reports to facilitate stalking, doxxing, intimidation, threats, blackmail, "revenge porn" campaigns, or any conduct prohibited by anti-harassment laws;
(d) Aggregate or resell data — combine dolphinradar data with other datasets to construct personal profiles for sale, advertising targeting, credit decisioning, insurance underwriting, employment screening, tenant screening, or any decision with legal or similarly significant effects on individuals;
(e) Train AI or ML models — use scraped data, dashboard exports, or API responses as training inputs for any machine learning, large language, or biometric model, whether for your own purposes or for resale;
(f) Circumvent technical limits — bypass rate limits, geo-block notices, payment requirements, the absence of an API, or any technical or contractual restriction;
(g) Reverse-engineer — decompile, disassemble, scrape, or otherwise attempt to derive the source code, internal logic, or data-collection methodology of the Service;
(h) Misrepresent identity — impersonate dolphinradar, falsely claim affiliation with Meta or Instagram, or use the Service in a manner that misleads other people about the source of data;
(i) Violate Instagram's terms — use the Service in a way you know or should know violates Meta's Terms of Service or Community Guidelines;
(j) Engage in illegal activity — use the Service for any purpose prohibited by federal, state, or local law in the United States, your jurisdiction, or any jurisdiction where you are subject to law;
(k) Use AI-generated insights to physically locate or approach a person — use AI Insights, location signals, venue mentions, or any inferred output to identify the present whereabouts of any individual, plan a physical encounter without that person's prior knowledge, or facilitate any conduct prohibited by anti-stalking, anti-harassment, or domestic-violence statutes;
(l) Use AI-generated insights as input to consequential decisions — use personality approximations, lifestyle indicators, public spending signals, or any AI-generated content as a basis for credit, employment, insurance, housing, tenant, educational, or other decisions that produce legal or similarly significant effects on the analyzed person. Our AI outputs are informational approximations only and are not consumer reports under the Fair Credit Reporting Act or any analogous law.
You are solely responsible for ensuring your specific use case is lawful in your jurisdiction. We do not provide legal advice; if your intended use touches sensitive categories (e.g., investigations, journalism, security research), consult counsel.
C.3 Enforcement
We may monitor for, investigate, and respond to violations of this Section C. If we determine in our reasonable judgment that your use violates these Terms, we may warn you, suspend your account temporarily, terminate your account permanently without refund of any prepaid amount, delete data we have collected on your behalf, and cooperate with law enforcement when legally required.
We are not obligated to monitor any use of the Service, and the absence of enforcement against one user does not waive our right to enforce against another.
D. Account, Subscription, and Billing
D.1 Free and Paid Plans
dolphinradar operates on a freemium model:
Free Tier — anyone with a valid account may use a limited version of the Service at no cost, subject to the feature, frequency, or quota limits described on our pricing page. Free Tier access does not require a payment method and does not auto-convert to a paid plan.
Paid Tier — to unlock additional features, you may subscribe to a paid plan at the prices described on our pricing page. Prices are stated in U.S. dollars unless otherwise specified. We may change pricing on a going-forward basis with at least 30 days' notice to existing subscribers; price changes will not apply to a prepaid billing period already in progress.
D.2 Auto-Renewal (Paid Tier)
If you subscribe to a paid plan, your subscription renews automatically. Unless you cancel before the end of your current billing period, we will charge the payment method on file for another period of the same length (monthly, quarterly, or annual depending on your plan) at the then-current price.
You may cancel a paid subscription at any time from your account settings (look for the subscription or billing section) or by emailing [email protected]. Cancellation takes effect at the end of the current billing period; after that, your account reverts to the Free Tier (you do not lose your account or data) unless you separately request account deletion. You are not refunded the unused portion of a paid period (see Refund Policy below).
D.3 Refund Policy
General rule: paid subscriptions are non-refundable. We do not refund partial billing periods, unused features, or accidental renewals more than 14 days after the charge.
We will, however, issue a refund in the following specific situations:
● The Service was materially unavailable for 7+ consecutive days due to our outage.
● You were charged after a documented cancellation request.
● You were charged in violation of applicable consumer law.
We may also issue refunds at our sole discretion in other circumstances we determine to be warranted.
To request a refund, email [email protected] with your order ID and reason. We process eligible refunds within 14 business days to the original payment method.
D.4 Taxes
You are responsible for all applicable taxes, including sales tax, VAT, GST, or other transactional taxes. We may collect such taxes where required by law and add them to your invoice.
E. Intellectual Property
E.1 Our IP
The Service, including the dolphinradar.com website, dashboard interface, report formats, visualizations, code, and the "dolphinradar" name and logo, is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes consistent with these Terms.
E.2 Public Data, Not Our Data
The Instagram data presented through the Service is publicly available information observed from the Instagram platform. We do not claim ownership of the underlying Instagram data; we claim ownership only of our methodology, dashboard, visualization, and aggregation work product.
E.3 Feedback
If you send us feedback, feature requests, or suggestions, you grant us a perpetual, royalty-free, worldwide license to use that feedback to improve the Service. We are not obligated to keep feedback confidential or to compensate you for it.
F. Disclaimers and Limitation of Liability
F.1 Service Provided "As-Is"
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of data.
We do not warrant that:
● the Service will be uninterrupted, timely, secure, or error-free;
● reports will be complete or accurate (Instagram's public data is subject to deletion, edits, privacy-setting changes, and platform-side changes outside our control);
● our methodology will detect every signal, change, or update on any tracked account;
● AI-generated insights are accurate, complete, or reflective of any specific individual's true characteristics;
● the Service will be available in all regions or at all times.
F.2 Data Latency and Gaps
Instagram regularly changes what is publicly visible, throttles automated access, and may make public data temporarily or permanently inaccessible. Reports may have latency, gaps, or omissions. You should not rely on the Service for time-critical decisions or as the sole source of intelligence for any consequential action.
F.3 Limitation of Liability
To the maximum extent permitted by law:
(a) In no event will we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, lost data, lost goodwill, or business interruption, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
(b) Our total cumulative liability to you for all claims arising out of or related to the Service, regardless of the form of action, is capped at the greater of (i) the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars (USD $100).
(c) Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
F.4 No Liability for Third Parties
We are not responsible for:
● the conduct of Instagram, Meta, or any other third-party platform we observe;
● the accuracy, lawfulness, or appropriateness of how you use our reports or AI-generated insights;
● any action taken by Instagram against any account you track or against you personally (including but not limited to account suspension, shadowban, or content removal);
● any breach of these Terms or applicable law by you or by anyone using your account.
G. Indemnification
You agree to defend, indemnify, and hold harmless dolphinradar, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to:
(a) your violation of these Terms, including any Prohibited Use under Section C.2;
(b) your violation of any law or third-party right (including, without limitation, any privacy, publicity, intellectual property, or anti-harassment right);
(c) your use of the Service to surveil any specific person where you lacked lawful basis;
(d) any action, claim, or proceeding brought against us by a person whose Instagram activity you tracked, where such action arises from your specific use of our reports or AI-generated insights.
We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us; you will cooperate with our defense.
H. Termination
H.1 Your Right to Terminate
You may terminate your account at any time by canceling your subscription and emailing [email protected] to request deletion. Upon termination, your access ends at the close of the current billing period (or immediately for Free Tier accounts), and we will delete your account data per our Privacy Policy retention schedule.
H.2 Our Right to Terminate
We may suspend or terminate your access immediately, without notice, if:
● you violate these Terms (especially Section C.2 Prohibited Uses);
● we are required by law, court order, or regulatory action;
● we discontinue the Service in your region;
● your payment fails and is not cured within 10 days;
● your conduct creates a material risk of legal liability for us.
On termination by us for cause, prepaid amounts are not refundable.
H.3 Survival
Sections C (Prohibited Uses), E (IP), F (Disclaimers and Limitation of Liability), G (Indemnification), I (Dispute Resolution), and J (Miscellaneous) survive termination.
I. Dispute Resolution
I.1 Informal Resolution First (30 Days)
Before initiating any formal legal action, you agree to first contact us at [email protected] with a written description of the dispute. We will work in good faith to resolve the matter within 30 days. Most disputes can be resolved this way without formal proceedings.
I.2 Binding Arbitration
If informal resolution fails, all disputes arising out of or related to these Terms or the Service will be resolved by binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules for claims under USD $250,000, or its Comprehensive Rules for larger claims. The arbitration will be conducted in English, by a single arbitrator, seated in Singapore, with the prevailing party entitled to recover reasonable attorneys' fees and costs as the arbitrator determines.
You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first agreeing to these Terms. Opt-out notice must include your full name and the email associated with your account.
I.3 Class Action Waiver
You and dolphinradar agree to bring claims only in your or our individual capacity. No class, collective, consolidated, or representative arbitration is permitted. If a court of competent jurisdiction holds this class action waiver unenforceable, the entire arbitration provision in this Section I (other than this sentence) is null and void, and disputes will instead be resolved in court per Section I.5.
I.4 Exceptions to Arbitration
Either party may bring an individual action in a court of competent jurisdiction for:
● small-claims disputes (within applicable small-claims court limits);
● injunctive relief to protect intellectual property or to enforce confidentiality obligations.
I.5 Governing Law and Venue
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. For any matter not subject to arbitration, the parties consent to exclusive personal jurisdiction in the courts located in Singapore.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
J. Miscellaneous
J.1 Modifications to These Terms
We may modify these Terms at any time. The "Last Updated" date at the top of these Terms reflects the latest revision. We will provide notice of material changes by a notice on the dashboard or other reasonable means in advance of the changes taking effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree, you must stop using the Service before the effective date and may request a pro-rata refund of any prepaid period.
J.2 Entire Agreement
These Terms, together with our Privacy Policy and any policies posted on dolphinradar.com, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
J.3 Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
J.4 No Waiver
Our failure to enforce any provision is not a waiver of our right to do so later.
J.5 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms to any successor or affiliate without restriction.
